They do own it since they own Rare.
It's Rare in specific that owns the games/IP. MS wholly owns Rare, yes, so in effect they also own Rare's properties, but no, lack of mention means nothing in this case as the trademarks are all filed directly by Rare itself. This is what you'd expect to see, unless it were a listing specifically for a new release that MS co-filed ownership of.
Not saying I think this page is in any way significant, mind you.

I really don't remember banjo in the Diddy Kong Racing for DS. I say that because if I remember right Microsoft release a Banjo Kazzoie 64 (edited without the n64 presentation) from that Rare collection. I don't think he was in it, but my point is that MS is fine with Rare games on Nintendo handhelds. It's just a matter of if they see the Switch as a handheld console or a home console, I think. I'm sure they can work out a deal though. Microsoft is giving away Rare Replay for free through Mixer during events like E3, and that's a better version of the game than the N64 game.
