Yes, but he was seemingly scrapped for legal reasons. If he's showing up in the copyright section now, it's likely that said legal problems have been sorted out since the initial leak.
There was no legal issues. It was obvious he was switched out last minute with Joker in KP1. As to why we'll never know.
The popular theory is that whatever legal issues that possibly came up was the reason why he was swapped out for Joker. I mean, why else scrap Ash of all characters (unless they really wanted to save him for Season 2)?
Legal issues would be a pretty good reason a last-minute replacement.

With the latest update, files relating to Ash, Fujin and Sheva were re-added. They were removed after they were first datamined from the Switch version.
This time though there was also a reference to a new character with the codename "ROB." You just might get your wish.

Arnold was a impersonator at least, now the Joker... NRS never used Hamill in Injustice so it was kinda obvious.
