Copyright claim still on foot, as is the breach of contract claim (only the 'exclusive' part was struck out). Punitive damages off the table for now. Most importantly, RSI was unable to wriggle out of the proceedings, as the judge found both RSI and CIG to be parties.
My take is that Crytek would dearly have loved the 'exclusive' claim to stay in, as it would potentially have been the most damaging. I disagree with the judge's interpretation by the way. There is still enough left in the lawsuit to make RSI/CIG very very uncomfortable, but settlement should now be more achievable, assuming RSI/CIG have the money to pay.
