Also, most people aren't going to end up in a confrontation with the cops wherein the cops are there because they suspect you're a potential mass shooter, waving a gun around in front of a hotel window.

He should have been asked to lay prone and then cuffed, not given an impossible set of tasks when having a .29 BAC.
