well the complaint seems to be that they were told the videos weren't going to be online at all, just put on physical media and sold to specific people. the videos were in fact put in their official website, which lead to them spreading to the various streaming sites.
But they agreed to do the porn under the condition that it wasn't being made widely available - but it was. By the offending party.
They might have needed the money in some cases, and were more okay with it not being spread to a wide audience.
I always thought "casting couch" pornos were made with actual porn actors or sex workers acting as unassuming models. Fucked up to find out they were actually being taken advantage of

We should really try and upgrade the legal porn age to 21, it won't stop these things from happening. It will however make sure their mind is fully grown and in the best place possible to make a decision about lifechanging events like these.

These aren't casting couch pornos. Every video starts off with the woman already sitting on a bed. Everything is in place from the jump.
gonna be a hard case to win. they can always claim they did give it to private owners who could have just ripped the shit to whatever website. then they can claim they just downloaded it from said website. i dont know how these girls thought that this stuff was ever going to stay "private" in the world we are living in today.

You can tell honestly that many of them are new and either are trying to get into the business or like this article states, some were doing it for a quick pay out. I think there has been plenty of backroom casting couch news where some girls only did one video, got paid good then ended up finishing their school and getting a job. Only to be later found out and harassed. Then of course you have the obvious porn stars that pretend to be amateurs on those videos.

I knew they used bait and switch with the ad to get girls to respond but telling the girls this will never go online is a whole other level of scummy. Probably illegal as well.

I've read half a dozen unconfirmed stories about them in the past, basically they set it up as a modeling shoot/nude modeling, fly the girl out to Los Angeles, and then tell them that it's actually porn.
If the girl refuses, they don't pay her and refuse to give her the return plane ticket/pay for a hotel. Most girls would be to embarrassed to call their family and tell them why they are stranded in LA. So they then coerce them by telling the girl it's for a private collector, no one will see it, ECT.
Here is an ama one of the supposed models did. There is no proof, but it lines up with what had come out about the company in the following years.
If they can prove that they made those false promises, in my view it's a very easy case to win, no doubt.

Ironically, telling them that they'll only be sold on DVD's to a few people in foreign countries is something so outlandish and unbelievable that you'd expect to hear it in a mainstream porn video.

I don't see how the defense of "but it was ripped on the interwebs not our fault" works when the defendants are uploading and hosting the videos on their official channel on the US' largest streaming site.
