Ryan S. Hernandez pleaded guilty on Friday to charges related to a 2016 phishing scheme that got him access to Nintendo's servers, where he was able to download several confidential files related to the Switch and forthcoming game releases. But he also pleaded guilty to child pornography charges, related to a directory of more than 1,000 sexually explicit videos and images of minors that he stored in a folder he labeled "Bad Stuff."

The Nintendo charges could get him a maximum sentence of five years in prison, but the child pornography charges carry a potential sentence of 20 years. Hernandez will also have to register as a sex offender. Prosecutors, in a plea agreement, have recommended that a judge sentence him to three years in prison. Hernandez will be sentenced on April 21, 2020.
In a statement from the office of Brian T. Moran, the U.S. Attorney for the Western District of Washington (Seattle), prosecutors said Hernandez had been contacted by investigators about the first hack in October 2017. Then a 16-year-old, he promised to stop his hacking.

"Nevertheless, from at least June 2018 to June 2019, Hernandez returned to his malicious activities," the statement said, "hacking into multiple Nintendo servers and stealing confidential information about various popular video games, gaming consoles, and developer tools."

Prosecutors say Hernandez boasted about his thefts on Twitter and Discord and leaked some of the information to others. They say he also operated an online forum, called "Ryan's Underground Hangout," where he shared information about Nintendo network vulnerabilities with others.

Hernandez has already agreed to pay $259,323 in restitution to Nintendo "for the remediation costs caused by his conduct," the office said.

Well, the child porn part is definitely serious and carries the much harsher prison sentence, but he also owes close to $260,000 to Nintendo for the hacking and leaks (after he already promised to stop hacking).

So even without the child porn charge, he'd still be feeling pain from having to pay the restitution. The double-whammy here just means he's Super Fucked, and justifiably so.

He was a minor in 2016 but not in 2019 when they came a knocking on the door. He's 21 as of today.

At this point, I feel like its more of a surprise when a hacker ISN'T busted w/ child porn on their computers. Not sure what about that lifestyle draws one to the other, but man; 16 and destroyed his life already.

I read this on Reddit a few hours ago. I think the OP here, much like in Reddit, is burying the lede. It makes people sympathetic towards him. "Big bad Nintendo cracking down on these freedom fighting hackers!" It's really not the case.

Anyways, I remember this dude from my Wii U scene days... He was a moron, but I couldn't have imagined he was also a fucking shitstain of a human being.

He was an adult when he was busted. But here's the thing: even if he were a minor, I have to imagine it'd still be a crime to be in possession of sexual pictures of underage people. At least, that's how it is here in Spain. I have to assume that it's the same in the rest of Europe, and, ostensibly, in the US. Somebody can shed more light on this, though.

The child porn charges are more serious matters than the restitution.
So I'm not defending the guy, and never would. But there is a distinction to be made here...

Considering the guy was caught primarily for hacking and the child pornography was a side charge, it's very possible that the child pornography was discovered as a part of the investigation. But that also means the child pornography charge could be from finding disgusting "Loli" hentai on his computer as much as it could be from discovering actual dark web pornography. Either way it's disgusting and horrible but the way the article and case are written makes you think it's the former than the later. Otherwise the child pornography would be the main part of the case. Either way, the dudes fucked and deserved it. But I merely question whether this is actually "burying the lead".

Which I realize opens me up to 100 responses but again, I'm not defending the guy and I'm not caring. I'm merely speaking from a legal point of view at most.

I doubt very much that they can accuse you of possessing pedophile content by loli hentai content. It is disgusting but for now not illegal.

It seems likely that Sabi came into contact with a hacker for her too-comprehensive E3 and Gamescom leaks at the very least, but there is no actual proof, only speculation and strong suspicions afaik

The article is from Polygon, since their focus is technology of course they're going to speak more about that than the other charges.
The mere fact he's facing up to 20 years in jail make it obvious that the charges of child pornography became the main driver of the case at this point, and neither the police nor the prosecution are a bunch of imbeciles, they wouldn't be charging him for freaking anime/manga. If he's getting charged, it's because they found that disgusting stuff.

He's a paedophile, no way to argue against that. I hope he rot in jail.

The US Law doesn't make a distinction. The FBI and Law Enforcement doesn't actively look for it, mostly because it's a waste of time, but they'll readily throw it as an extra charge if the discover it in the process.

Again, not defending the monster, but the fact that it's implied to be a subsequent charge definitely opens up the door for such a scenario.

Pretty sure it's the same here. I remember people warning teens of sexting and sending dirty pics to their SOs for this reason. But yeah, somebody corrected me that he wasn't a minor.

It has not been proven because it has not been found, but people have said that it is the only way they could get the list of so many games in E3.
If it were the one occurrence maybe, but they also got things from Gamescom and a Nindies direct, in addition to the VR Plant stuff. I just find it weird to believe every one of these cases is due to hacking.
