Forty-four-year-old Tadaaki Abe has been arrested in Kagawa, Japan, for modding a PlayStation 3 and then selling it.

According to NHK, Abe is accused of jailbreaking PS3s so game discs could be copied and then played without re-inserting them. He was arrested for selling a modded PS3 for 15,555 yen ($145) to a Tokyo man in his 40s.

Japanese modders can't even build 3DS with video-out anymore, or Famicom with RGB. That's fucked up.

The modded PS3 was sold last year through an online auction site. Abe, a part-time worker, was arrested yesterday. In an affidavit, he said he did this for income.

Authorities found 40 PlayStation 3 consoles in his apartment and are currently investigating whether or not they have been modded

He was doing this as a business. And that's illegal in Japan.

So not sure what you're expecting here.

They're notoriously strict on anything like this. It's not really shocking news.

I'm willing to bet many don't know.

Just because it's been a thing doesn't make it right.

To be fair one of the modifications he made would allow a person to buy a PS3 game physically, download it off the disc, and then resell the game.

True but you could say the same thing about a Blu Ray drive yet those seem to be selling just fine.

Through emulation, yes.

I don't know what Japan's laws are on third party emulators. I'd hope they'd be similar to the US's.

The big PS3 emulator is RPCS3. I'm not aware of any other.
My point is: just ripping a BD on a BD drive isn't illegal as you still need a modded PS3 to play the game.

I'm not sure what PSP patch you're referring to, but that depends on the method used for the "jailbreak" and using a modded console/handheld always implies in that sort of risk anyway.

There are plenty of sites that do the same in the US and EU and it's totally legal.
Selling a modified console is kind of grey market, tbh. A consumer should have the right to modify their own physical property, especially given the scrutiny lately surrounding right to repair, but outright selling pre-modified consoles probably violates some DMCA laws regarding copyright circumvention. It's not that reselling a system is actually illegal in Japan (otherwise stores like Super Potato wouldn't exist) but doing what he did absolutely is. You need a license for it and he was doubling down on the thing by selling them pre-modified.

Isn't jailbreaking legal in the US? Seems like people should be able to modify their consoles as they please.
If you do it yourself, yes. doing it as a business is very likely a no-no.

Damn, they're serious about enforcing this. I hope we don't hear about people being punished for software mods and trainers. They technically can be fined/arrested, according to the ammendment, if they're distributing them. I'm unclear on whether downloading such a thing would be an offense.
