This is the problem with the DMCA and Content ID: they're always proactive in favor of the copyright holder, even when they're in the wrong. So while DF and others doing reviews can and should contest this, even taking it to court, the financial damage is already done.

Why is there so much hostility toward each other in this thread? Besides the fact that it's just hostility over video games, it's also a very strange situation of publishers and copyright holders where it makes sense for there to be confusion. It's not quite as simple as "lol didn't read".

Part of the thread reads as a bunch of confused people being mean to each other lol.

So if I'm understanding this correctly there's this Marvelous Games Twitter account which seems to be Marvelous Europe, Marvelous Inc. which is the Japanese parent company, and Nintendo. Neither Marvelous Games, nor Nintendo have anything to do with these copywriter claims, it's actually all on Marvelous Inc in Japan who at this point hasn't actually commented.

Is that correct?

The game ain't going to sell with no hype Marvelous. Well it wasn't going to sell much anyway, but allow the game to breathe.

Nintendo has nothing to do with this situation, it's Marvelous Inc. who are making the claims.
This is going to need to be at the top with sirens at this rate. Usually people only read the title, lol.

Yes, that's exactly it. Nintendo could potentially have a word with Marvelous Inc. regarding the copyright claims for European/American outlets because they're publishing the game in the West, but that doesn't mean they can remove the claims or do anything directly.

It would be like if Square Enix was putting claims on Dragon Quest XI S or Octopath Traveler videos, basically.

They're obviously welcome to as a policy, but I think it's going to hurt the game more than content producers. It's already way under the radar and I don't see many people chomping at the bit for coverage. Great way to handicap your product when you could really use some positive word of mouth.

Not saying I agree with it in this case, these claims should absolutely be dropped, but it definitely makes more sense for the system to default in favor of the copyright holder.

In theory I don't disagree, but in practice both of the systems in place are hilariously easy for bad actors to abuse with few repercussions and Content ID specically, even when working as intended, lacks all contextual awareness and as such becomes a method for Youtube to divert money away from people who are legally allowed to profit from their content.

It really is our loss. As great as the Directs and Nintendo Minute are, there are things that get less to no profiling from time to time. In NA they probably should have set up a Treehouse co-op demonstration session with the release build anyways.

Last year at this time it was Shadow of the Tomb Raider that was released into a stacked calendar and disappeared into discount just a couple of weeks later. And this was a marquee-name franchise. DxM doesn't have any of this clout but is being released under similar calendar conditions.

The only reason I can see is the game is getting decent reviews at best in its coverage. But maybe its just some outdated view on how youtube can help your games.

Love the people shooting first rather than reading.

And Marvelous Inc. can't be contacted directly (even though they're making claims directly)? That's kind of fascinating if that's true. But these Western outlets are probably going to contact NoA/NoE, who will contact NCL, who will contact Marvelous Inc., right? That's a long chain of communication.

It'd be hard for an english-speaking individual to contact a japanese company. The best route would indeed be to approach Nintendo since they're likely working very close to Marvelous inc. with the game launching worldwide this friday.

Marvelous Europe is just a small publishing branch. They can't do much.
