Video of the incident.

This shooting occurred last month in a Charlotte, North Carolina Burger King's parking lot.

Kerl and the other officer continue yelling at Franklin to drop his weapon. Altogether, they yell commands like "drop the gun" or "put it on the ground" at least 24 times. Franklin's left hand is between his legs, and you can't see his right hand from the video.

The video shows Franklin move his right hand with what appears to be a gun. He does not aim it at the officers. It appears the butt of the gun is facing the passenger, with the barrel pointed at Franklin. Kerl fires her weapon twice, striking him. He appears to yell, "you told me to" while officers continue to command him to put down the gun.

A judge had ordered the footage to be released last week. Several city officials earlier today had press conference earlier before the footage was released. Protests are being planned.

This is in my town. Down the street from where I live. It occurred a mere two days after a famous local restaurant fired a black man for being a communist and allegedly Antifa (he was, but all of this was conjecture thrown at the restaurant by a local extremist group called Deplorable Pride) and called him in to the shop just to publicly humiliate him by having CMPD escort him out "for the safety of his patrons and employees."

I'm fairly involved with local politics. Things are pretty scary right now. We're known as a "democratic bubble" in a sea of red, but especially adding in the ICE raids over the last three months and a noticeable increase in police activity all over town and particularly in the hood where I live things are beginning to feel like we're under siege.

The RNC is here next year. It's gonna be apocalyptic.

That video was an execution. Zero real attempt to deescalate the situation that they immediately created upon hopping out of their squad cars with guns pointed. Shouted, conflicting orders while surrounding the guy guns drawn. He was completely surrounded and on his knees, surely there were multiple non-lethal options if you're not even going to try to end the matter peacefully. I can't even imagine what was going through his mind there.

I know one thing, and that's that having 3 or 4 people yelling orders at someone from all directions with guns drawn is probably the least effective way to get a calm and measured response from someone and it creates an environment where the cops are also going to be more likely to react (to anything) in a non-calm or measured way as well. Current police training is terrible and it's literally killing people. De-escalation needs to be emphasized more.

Basically what I saw here was he had a gun (which apparently in USA is legal).

The Police have their weapons pointed at him, obviously with the intent to shoot at any moment. He proceeds to drop the weapon, and they just shoot him anyway .. ?

If there's any doubt he was complying with their orders to put the gun on the ground, here's a still of the man immediately before he was shot, holding the slide of the gun with the muzzle pointing away from the officers and the passenger.

There literally has to be a body that overlooks cops and the agency. Fuck the cop union or whatever. There needs to be a regulating body holding these killers accountable.

Multiple screaming voices, often with conflicting orders. Probably best to just do nothing at all. Not even blink. Maybe you have higher survival chances. Complying clearly doesn't work.

It's insane how trigger happy the US police is. Probably what you get for 6 week of training.

In many countries becoming a police officer means 3 years of practical training and various tests.

And an important part of that training is that if you shoot someone you can say you felt your life was threatened in that moment and precedent makes that a valid defense in court. Like the people who train these guys go just short of saying to them "You can do this and you'll go to court but get off. Plus, mandatory paid vacation!"

Anyway wonder if we'll get those "but my sister-in-law's cousin's oldest son is a cop! how dare you" commenters in here (no I don't, I'm sure they'll skip this thread)

they "feared for their lives." Assuming this ever goes to trial, that's all juries will need to hear, regardless of what the video shows, and nothing will happen. We've seen it too many times to expect anything different. American cops have a license to kill, basically.

As I said, even if the victim was doing something wrong (like a robber) the cop just used excess of violence, it's lampant, but normalize the act to have a gun in your pocket and going in a burger king with it is extremely disturbing to me.

I guess this is just the norm for people lining live in USA.

Yes, I think that they just needed to tell him to puts hands in the air slowly and then approach him and slowly arrest (for future investigation).

Ask him to pick the gun and put it down sounds crazy to me... is that even the protocol?
Really, just let him show you the hands so he can't be a treat to any of you.

I'm going to assume that you're not a United States citizen.

We have a thing called the 2nd Amendment which allows people to own personal firearms. It's complicated, in that only over the past few decades has it been opened up the way it has, but regardless, plenty of United States citizens can legally own firearms. We even have concealed carry licences that allow people to carry weapons, concealed, wherever they go so long as the establishment does not have it posted that weapons are not allowed. Which, truthfully, isn't the case everywhere.

So, it's perfectly normal, in the United States, for a random person to have a firearm, on their person, concealed, going into a Burger King.

What this cop did is at best manslaughter and should be prosecuted as such.

Because there is nothing scarier to a cop than a black man who does, or might have, a gun.

Doesn't matter how many officers are aiming their own guns.
Doesn't matter what position the black man is in.
Doesn't matter if the gun is even on his person.

Their fear will always be telling them it's still possible for him to get the gun and kill them so they have to kill him first.

He was dead as soon as the police arrived. There's not a lot a black man can do in that situation. So long as he's armed, he pretty much can't move at all without being shot. Hell, he could've had nothing on him and the same thing would've happened. If the cop even thinks he poses a threat, he's dead.
