What’s that Pop Up? Your Activision Games Are On the Cloud - Xbox Wire

When we welcomed Activision Blizzard to Team Xbox, we reaffirmed our goal of bringing more Xbox games to more players on more devices. Today, we're making a small change to four games as part of that commitment.

When we welcomed Activision Blizzard to Team Xbox a few weeks ago, we reaffirmed our goal of bringing more Xbox games to more players on more devices. To that end, we made a commitment to the European Commission to enable European Economic Area (EEA) gamers to play current and future Activision Blizzard PC and console games that they hold a license for on cloud game streaming services beyond Xbox Cloud Gaming.

We met this commitment in October, and are now reflecting these changes in four live service games that have an in-game software licensing agreement. While many of you may have already been streaming Activision Blizzard titles, beginning today, the next time you boot up Call of Duty®: Modern Warfare® II, Call of Duty: Modern Warfare III, Call of Duty: Warzone™, and Crash Team Rumble you will be asked to accept an updated Software License and Service Agreement.

The full terms of this agreement can be found here, but as we know you'll be eager to jump into your game, we're sharing that the change is a small one, reflecting the grant of a free license to EEA consumers that allows them to stream that title, via any cloud game streaming service of their choice that supports streaming the game, on any device they may own.

When you see this pop up, know that what you might see as a minor inconvenience is indeed a sign of us honoring commitments, and indicating that you, the players of these games, have permission to enjoy these titles in a way you previously could not.

This is the only time you will see a pop up of this nature. Going forward, these licenses will be incorporated into the terms of use when games are released.


ACTIVISION BLIZZARD CLOUD STREAMING IN THE EUROPEAN ECONOMIC AREA

FOR INDIVIDUALS BASED IN THE EUROPEAN ECONOMIC AREA:

As of October 13, 2023, in line with the commitments Microsoft made to the European Commission (the "Commitments") covering the European Economic Area ("EEA"), the following EEA Consumer License language is effective with respect to all relevant end user terms covering all Activision Blizzard games (so-called Eligible Games, see below):

As an integral part of its End User License Agreement (EULA), Microsoft agrees to allow Consumers to play, solely for their personal use, Eligible Games on a Streaming Service on any device that they own, as defined in and pursuant to the Commitments entered into by Microsoft and made legally binding by the European Commission in its decision under Article 8(2) of Regulation (EC) 139/2004 in case M.10646 – Microsoft/Activision Blizzard.

Seem to be a few games in here you can't buy anymore or are a bit limited? Transformers Devastation comes to mind.

Next time you boot these games in Europe, PC of Console, you will need to accept a new ToS

I assume this is just games that you already own, and that these are NOT being added to Game Pass yet?

This is just a list of eligible games, right? I have a hard time believing Guitar Hero, Skylanders, or Transformers will be available from the cloud. Unless they're legally required to? Idk, this news brief is kind of confusing.

Hm..... hum.... let me get this, this means that anyone who has a license for any of these games on any platform provider can opt to play them through streaming on a service that is provided by Xbox? Is that it? Like if i own Call of Duty: Whatever Warfare on Playstation, i'll have the option of playing it on the the cloud service that Xbox provides?

What are Microsoft's legal obligations in the European Economic Area (EEA) under the EC Commitments?

As of October 13, 2023, Microsoft is actively fulfilling its obligations under the EC Commitments in the EEA by making available:

Microsoft's EC Commitments will last for ten years. As the deal closed on October 13, 2023, the Commitments will last until October 13, 2033.

Do I still need to pay a subscription fee to cloud streaming providers even if I now have the right in the EEA to cloud stream Eligible Games?

Consumers based in the EEA that have a license to Eligible Games will not have to pay anything to Microsoft – beyond what they initially paid to acquire the game – to take advantage of the consumer license. The streaming provider may still charge for its streaming services, but that is up to the specific cloud game streaming service.
