My mind says they probably violated something similar contractually to due process. The other being the video was doctored and what was written qualified as libel.

Based off the 1st and 5th amendments? That seems pretty weak.

The argument from the White House is paper-thin but don't they have the right to revoke press passes as they see fit? Just seems like allot of hot air from CNN.

If you restrict press passes expressly to coerce newsrooms to give you favorable coverage, you are restricting free speech as a government entity.

At least, I think that's the argument.

They have a right to report the news, do they have a right to access to the White House? They've always had to be vetted and credentialed, presumably the executive branch can withhold access to anyone they want.

They can't discriminate for any reason they want. They're clearly singling our CNN for political views. Id say CNNis likely to win.

I'm talking about how you said "this backfired on them". As far as I can tell CNN still has pretty ridiculously high ratings and things like this are not going to hurt their ratings in the slightest, so I'm just trying to understand how that qualifies as "backfiring".

I'm not saying anything has backfired or not, but they aren't doing as well as people may think.

This should be a no-brainer in favor of CNN and Jim. That said, if a decision comes down against them it could have massive implications on media access moving forward. I suspect that Trump/WH cave on this but you never know withthis administration.

AFAIK, Fox has always been way out on top, and I'd have thought CNN would be doing worse than those numbers you show, considering how many of his dumb cult members buy his bs about "fake news".

Thanks for the data. Wow so CNN is up from 490K daily in 2015 to 689K now. I did not expect that. I guess his cult members were never watching it back then either. How was Fox doing at the same time in 2015?

I asked for 2015 because it was before the whole "fake news" smearing of the network by POTUS, which appears to have influenced many people in the US.

The ratings for 2015 (Nielsen Live + Same Day data):

Fox News Dec 2015

But yeah, Fox News watchers have disliked CNN for decades.

That certainly makes sense, although the White House cited him touching someone as the reason, not his coverage. I mean, yeah, there is no question they're lying, but officially, they didn't revoke it to encroach on freedom of the press at all.

I would imagine that this is an issue that the court is going to have to determine. The White House can't get away with violating the 1st Amendment just because they manufacture a lie to cover up the true reason. So CNN will probably have to argue the case that their press pass was revoked because of their coverage and that the officially stated reason that Acosta assaulted the reporter doesn't stand up to scrutiny.

I haven't looked at the demographics so I could be way off here, but there are probably a few factors to consider, and yes I realize I'm responding to your generality with my own:

1. Fox's demo presumably skews older? Those people tend to be more conservative, and are watching more TV.
2. Younger people are watching YouTube and playing Fortnite, not watching Fox or football.
3. The rising number of hispanics may be watching more Spanish language channels.
4. The #1 network Fox has a daily viewer count of 1% of the US population.

What I'm saying is, it's a lot more diverse than those TV rankings might suggest.

One of the main reasons Fox is number 1 is that it's pretty much the only right wing channel. The left is split all over the place since there are options abound.

Even if we bump up Trump's base and give him 50% of the population, that's 50% of the country watching a single channel versus the other 50% choosing among CNN/MSNBC/CBS/CSPAN etc. Obviously individual channel viewership is going to be lower on that side.
