I found a way of not doing any work for half an hour and this is the fruit of my labours! I haven't bothered to list racing games for the most part as the licensing issues with those are fairly obvious. These are my best guesses as to what to expect from the program focusing on the most wanted and critically acclaimed games.

Activision:

Crash Bandicoot: Wrath of Cortex (available for purchase on 360)
Hunter: the Reckoning Redeemer (first game available now)
Metal Arms (available for purchase on 360)
The Legend of Spyro: A New Beginning (available for purchase on 360)

Wreckless (not developed internally, original developer Bunkasha is defunct)

Bethesda:

Return to Castle Wolfenstein: Tides of War (iD have the rights, available on other digital stores)

Capcom:

Capcom Fighting Jam (is on the PS2 on PS3 program)
Capcom vs SNK 2 (is on the PS2 on PS3 program)
Dino Crisis 3

Genma Onimusha (remaster available)

EA:

Buffy (EA no longer have the license)
Burnout (originally published by Acclaim)
Burnout 2 (originally published by Acclaim)

Burnout 3: Takedown (licensed music but SSX 3 made it over, available for purchase on 360)
Lord of the Rings (series, Warner have the license)
Medal of Honour (series)
Oddworld: Stranger's Wrath (gets ported to everything)

TimeSplitters 3 (THQ Nordic have the license)

From Software:

Otogi (published by Sega in the west)
Otogi 2 (published by Sega in the west)

Koei Tecmo:

DOA3 (Aerosmith music)
DOA Ultimate (Aerosmith music)
DOAX Volleyball (licensed music)

Fatal Frame (is on the PS2 on PS3 program)
Fatal Frame 2 (is on the PS2 on PS3 program)

Konami:

Castlevania Curse of Darkness
Shadow of Memories (Europe exclusive on Xbox, released globally on PS2, known as Shadow of Destiny in the US)
Silent Hill 2
Silent Hill 4 (is on the PS2 on PS3 program)

Lucas Arts:

All remaining Star Wars games!
Armed and Dangerous (available for purchase on 360)
Indiana Jones & The Emperor's Tomb

Microsoft:

Azurik
Blinx 2
Bloodwake
Brute Force (just for Phil)
Fable (available for purchase on 360)

Forza Motorsport (car licenses, FM5 and FH1 delisted)
Halo CE
Halo 2
Kung-Fu Chaos

MechAssault (very muddy license issues)
MechAssault 2 (very muddy license issues)

Namco:

kill.switch

Quantic Dream:

Fahrenheit (QD have the publishing rights to their own game, available for purchase on 360)

Rockstar:

GTA3/VC/SA (lots of licensed music with expired rights, will only happen if modded out)
Manhunt (is on the PS2 on PS4 program)
Max Payne (available for purchase on 360)
Max Payne 2 (available for purchase on 360)
The Warriors (is on the PS2 on PS4 program)

Sega:

Crazy Taxi 3 (licensed music)
Gunvalkyrie
Jet Set Radio Future (licensed music)
OutRun 2 (Ferrari license)
OutRun C2C (Ferrari license)

Sega Soccer Slam (available for purchase on 360)
Shadow the Hedgehog (is on the PS2 on PS3 program)

Shenmue II (HD remaster coming this year)
Sonic Heroes (is on the PS2 on PS3 program)
Spikeout: Battle Street
Super Monkey Ball Deluxe (Dole references already removed)

Square Enix (or the old Eidos):

Deus Ex: Invisible War
Thief: Deadly Shadows

TimeSplitters 2 (THQ Nordic own the license)

THQ:

Destroy all Humans 2 (first game is available)

Ubisoft:

Cold Fear
Deathrow
Far Cry Instincts
Prince of Persia: WW (was ported to PS3 with Godsmack music intact)
Prince of Persia: TTT (was ported to PS3)
Splinter Cell (was ported to PS3)

It would be a sin if Timesplitters didn't come across. Silent Hill 2 would be good

Wasn't Kung-Fu Chaos ( amazingly underrated game ) published by Microsoft? Surely that would come over to the program. Same for Brute Force.

That's my big hope. Microsoft have been pretty good about sub-licensing it but I am worried it would be considered more hassle than its worth.

I hope they do it. I absolutely love Outrun 2 on the Xbox.

As for additional games to be added:

Jedi Outcast
Bloodwake (did this have licensed music? I forget)
Hunter The Reckoning Reedemer
The Suffering
The Suffering 2
Metal Arms

Not sure about Kung-Fu Chaos but Phil Spencer hates Brute Force so maybe the BC team will get round to that one just to troll him.

Fatal Frame 3 was never ported to Xbox.

Oops. What is with third iterations of Fatal Frame and Silent Hill not getting Xbox versions?!

Phantasy Star Online is not impossible, although its Xbox Live implementation does pose an obstacle.

I dont know about fatal frame, but Silent Hill 3 definitely had tech in it that I guess just couldn't port well. Considering 4 didn't have the dynamic animated textures that 3 had and was ported to xbone, I'd guess it's those.

Burnout 3 is still for sale digitally so licenses are still intact. I'm thinking it has a good chance.

Also I think multiple Splinter Cell titles, perhaps all, are looking good also.

No sure about The Suffering now that Midway is gone. Loved the first game, wouldn't mind playing it again.

Dead or Alive Xtreme Beach Volleyball probably has a low chance due to it's licensed music soundtrack.

Did Ultimate Spider Man get an og Xbox port? I had the PS2 and Gamecube versions and I absolutely loved that game, admittedly mostly due to the fact that my beloved Venom is a playable character, so I'd kinda go nuts for an uprezzed port with improved load times and performance on my X.

OP, what are the chances of seeing any of EA's James Bond games from that generation? I know they don't have the license anymore, but does that prevent re-releases of already made games?

Dead or Alive Xtreme Beach Volleyball probably has a low chance due to it's licensed music soundtrack.
Analogue face buttons were also needed and those were dropped from the 460 and XBO controllers.

Part of me still thinks that Sega heard the demand for JSRF and will chase the music licenses again.
Crazy Taxi 3 is something I really want to see return but that seems even less likely due to music and advertising licenses.

why is JSRF red while the others are grey? why is licensed music a problem for these titles but not for SSX3?

It's my best guess, EA seemed to have been a lot more forward thinking than other companies when it comes to this issue. Also BO3 is already on the store. I changed all the DOA games to red.

I'm not entirely sure. I know they were both released on GOG.com last year, which makes me assume whoever has the license is still interested in making money off of them.
Doesn't WB fully own all Midway properties?

Ah sweet, that's encouraging.

Now that Mercenaries is coming, my #1 ask would be Gunvalkyrie.

JSRF and SSX3 would be runner ups.

Silent Hill 2/4
Splinter Cell DA (completely different than the 360/PC/PS3 game)
Buffy
Otogi 1/2
Burnout 3
Fatal Frame 2

Bonus:
Fable
Halo 1/2
Unreal Championship

And I'm a happy man.

All of the remaing games that can still be bought digitally and haven't been BC on Xbox One will likely become BC on Xbox One in the future.
These remaining titles are:
Crash Bandicoot: The Wrath of Cortex
Fable
Fahrenheit/Indigo Prophecy
Halo: Combat Evolved
Burnout 3: Takedown
Metal Arms: Glich in the System
Splinter Cell: Chaos Theory
Gauntlet: Seven Sorrows
Guilty Gear XX #Reload
The Legend of Spyro: A New Beginning
Zapper: One Wicked Cricket
Raze's Hell
Sega Soccer Slam
BlowOut
Max Payne
Max Payne 2: The Fall of Max Payne

MechAssault (very muddy license issues)
MechAssault 2 (very muddy license issues)

What's muddy about it? The sub-license of Battletech (which may only include PC titles anyways) expires in 2020 so, even if that's a limiting factor that MS can't negotiate with Piranha Games about, it should eventually come.

The first Buffy game would be main pick from that list (Halo CE sounds like it's already covered with the MCC), but it's marked in red. Bummer. I guess that means it's probably not coming.

Ah, forgot about Max Payne 1 & 2. I'd love to see those BC. Max Payne 2 in particular was one of the best-paced games I've ever played (at the time, anyhow).

Yup. The Xbox version is the one I have. I replayed it and the other Spider-Man games a year or so ago. Still a lot of fun.

Onimusha has licensing issues to with the main character's face looking like a famous Japanese actor. Don't know Capcom wants to shell out the money.
