If the FTC administrative hearing takes place and MS loses, MS can appeal, as I understand it, to federal court, where they'd likely win based on the law as it stands.
AFAIK the FTC usually drops the administrative trial if they fail to get a PI, but this merger has been special so who knows.
FTC court has no legal power for either side. End result is just a recommendation for the FTC chairs.
