Is there still an FTC in house trial in August? And what would that look like?

If the FTC administrative hearing takes place and MS loses, MS can appeal, as I understand it, to federal court, where they'd likely win based on the law as it stands.

While the PI trial and the Appeal isn't really based on the merits as far as I understand, I can't imagine it would help your future attempts at blocking the deal when you have failed bigly twice in a row.

Just to clarify - court listener only refreshes once someone with an access to PACER has downloaded a new document using Court Listener's thingy. So it's not a real time tool. CourtListener has last updated @ 3:17pm California time, while Pacer Monitor was updated 4 minutes ago. So, I guess I'm just confused, I don't see why we have a countdown to midnight because I don't think MS is gonna close over the CMA given there's literally a CMC on the 17th. I think they're gonna bank on the emergency stay to be denied and just cleanly close with the new agreements with the CMA.

No worries. I am paying those 15 cents per refresh every now and then to keep era up to date, but thankfully most of the time someone else (brokers?) pays on pacer monitor.

So, I guess I'm just confused, I don't see why we have a countdown to midnight because I don't think MS is gonna close over the CMA given there's literally a CMC on the 17th. I think they're gonna bank on the emergency stay to be denied and just cleanly close with the new agreements with the CMA.

Because there's a tiny chance the 9th Circuit agrees with the FTC and kills the deal.

I can imagine FTC people spamming F5 furiously to get response from ninth circuit.

I think emergency motion will get denied or no response before 11:59pm tonight. 50+ pages of Judge's decision should be more than enough for judges to deny FTC's request.

The countdown is for the TRO expiration. There's also word by Tom Warren about the CMA issue being fixed but nothing will be made public or official until the TRO expires.
