Feels like kind of a weird "trying to avoid sounding biased" add-on to say he gave the delay a thought after just previously calling the idea a non-starter.

Not that a Trump testimony is really going to add anything credible to his case at this point whether he were gagged or not, this just spares everyone his useless and endless process complaints.

Pausing the trial to hear an appeal of a gag order that will surely fail anyway is definitely a non-starter. That says Kise can't trust his defendant to not violate the gag order under testimony - which would surely yield objections from the state anyway if he starts going off topic.

As Engoron said to Kise earlier in this proceeding, "Control your client!"

And if he can't be controlled, don't call him to the stand.

We've wrapped early today. And as Eric Trump is, a bit surprisingly, not going to testify for the defense we get tomorrow off. Court resumes Thursday.

(They probably reckoned that Eric would not stand up well under cross examination.)

By my reckoning, the defense has two expert witnesses left. Eli Bartov and Gregory Christovich. They've used very few of their fact witnesses, and those that have appeared have done them little good. So probably just those two and Trump to go, if Trump shows at all.

We're pretty close to the end here.

He's still hung up on that assessment. He truly is a stupid man.
Because the assessment is a damaging blow to his self image and ego. Someone in a position of authority dared to say that one of his prized possessions that he brags about isn't worth anywhere near what he says it is, and it eats him up inside. He can't have people thinking he's anything less than the greatest.

If "errors like that are not unusual", I'm sure he'll have no trouble finding many examples of others estimating the square footage of their properties at roughly three times their actual sizes.

This is only a ruling on the defendants' motion to stay things pending appeal, it's not a final determination of the appeal itself.

Where we are now is that cancellation of the business certificates is still stayed pending appeal (because it isn't reversible, or not easily), but the rest of the things asked for (I can't quite remember what they are, but they include things like nominating potential receivers, and reporting requirements, and restrictions on moving assets out of state and so on) are un-stayed.

I think New York Court of Appeals is in fact the highest NY state court (weirdly the NY state supreme court is lower), so if I'm understanding right, given this is entirely a NY State civil matter, this is literally it. Trump org is toast, no more, do not pass go, decision is final.
