The licensing issue is it being on the xbox one store. Does the BC emulation require a game's source code for the optimization process? Or if it is just "I need your nod and just the game" situation?
So they don't even need to look at the source code to understand how certain things work? Just throw the game into the emulator and do adjustments base on debug info?The latter, the source code is untouched even for X enhancements.

I was talking to a couple of friends who work in the industry about why there isn't a 4K patch for RDR on BC. Their point is Rockstar's project management is probably a mess, it doesn't help that RDR was known for being in dev hell before the benz salvaged it so the code is probably very problematic to handle, and that might prevent MS from working with Rockstar on that. When RDR was made BC its sales shot up a 6000% or so, 4K patch could have a similar effect. It's win-win for Rockstar.It should be possible yeah. Rockstar are big on back catalogue sales (I mean they even put everything on the PS2 on PS4 program!) so I could totally see it happening to promote RDR2.

I think they'll be in the next batch of original XBOX BC titles. We're expecting another one soonish.

RDR was definitely testing issues. It was being tested internally early into the program, so it took around a year or so for it to actually release.
