List of allowed Marvel characters to be used by Insomniac Games for the X-Men and Spider-Man contracts

Note that Marvel can add and the section can be amended with new characters. From the Wolverine leak we can infer there have been amendments since the cast leak has Sasquatch (Walter Langkowski) and an original character/mutant (Devina). We also know that original characters - as have been created in the Spider-Man games are allowed and Marvel has final say to veto or give the go ahead as per the contract.

Context for the branding/style (I only have the one for the X-Men contract, but everything points to the SM contract being very similar). I would venture to say that other Marvel contracts (i.e. Ironman/Black Panther with EA, Blaze with Arkane, etc). It's probably similar to SW contract verbiage since it's all Disney. They use a template.

Attachment A to Schedule #1 Included Marvel Characters and Marvel Style Guides For purposes of the Licensed Product, Marvel hereby grants to Licensee specifically and solely the following characters and Marvel style guides (collectively, the "Marvel Style Guides"): I. MARVEL CLASSIC STYLE GUIDES The Marvel Classic (as defined below) characters set forth in Attachment A-1 in the style in which they appear in the Marvel Universe Classic Style Guide, and Marvel-created vehicles, weapons, clothing (including character suits), and fictitious locations commonly associated with such characters. "Marvel Classic" means the embodiment of the Marvel characters as originally conceived and as they appear in the comic books owned and/or controlled by Marvel (and not based on audio/visual works (e.g., movies, animation)) and widely known to the popular imagination through successive classic (i.e., faithful in appearance and characterization to the original comic books) interpretations in such comic books. "Marvel Universe Classic Style Guide" means the Marvel Style Guide comprised of the Marvel Classic versions of characters owned and/or controlled by Marvel designed for, depicted in and/or advertised, marketed and/or promoted in connection with Marvel's comic book and trade-paperback publications. Licensee shall be provided with access to the Marvel Universe Classic Style Guide via the Marvel Licensing Site. Attachment A (Included Marvel Characters and Marvel Style Guides) may be amended (e.g., to add one or more Marvel Classic characters or style guides) solely via written notice (e-mail sufficing) from Marvel's Legal Department which is confirmed by Licensee via return e-mail. II. GENERAL 1. Copyright notice and other legal notices: Each name and character likeness shall be accompanied by one the following legal lines, each where applicable as directed by Marvel (or otherwise as designated): © MARVEL or © [insert current year] MARVEL 2. The Licensed Product shall not portray or imply that any X-Men Family character is a member of a different group of super heroes or super villains not part of the X-Men Family (e.g., the Avengers). 3. In no event shall the license grant hereunder include any characters not listed in Attachment A-1 or, for the avoidance of doubt, any of the following (i) through (vii): (i) characters and/or the portrayal of characters in comics based upon all media style guides including, but not limited to style guides based on live-action television, Direct to Home Video, animation, other video games; (ii) the following Marvel programs/style guides: "Marvel Retro", "Super Hero Squad", "Marvel Kawaii", "Spider-Man and Friends, and "Marvel Babies;" (iii) characters from Malibu comic books or from Marvel's Affiliates (.e.g., Pixar, Star Wars, et al.); (iv) groups or families of characters newly created by or on behalf of Marvel subsequent to the Effective Date that are not super heroes (human) and do not have powers similar to a typical super hero and do not primarily interact or are primarily associated with super hero characters (i.e., guest appearances by super hero characters shall not automatically include the host in the character grant of this Agreement), (v) Marvel Zombies and Marvel Apes; (vi) characters acquired from third parties, which are not incorporated into and are primarily kept separate and apart from the Marvel Universe of which Marvel advises Licensee, including without limitation any Disney, Pixar and/or Lucasfilm characters; (vi) any characters that Marvel informs Licensee must be excluded for business or legal reasons, provided that in the event that Marvel so excludes any character, Marvel will use commercially reasonable efforts to provide reasonable alternative character(s) possessing similar attributes; and (vii) any interpretation of the Marvel Property which Marvel in its sole discretion deems inappropriate or which Marvel deems is not in line with the branded message of the overall Marvel brand and programs.

Marvel treating Quicksilver and Scarlet Witch as mutants warms my heart. Kinda interesting IGs cannot use any "X-Men Family character is a member of a different group of super heroes or super villains not part of the X-Men Family (e.g., the Avengers)" so they could not make them part of the Avengers, which is kinda weird. That said I just want Marvel to undo the retcon in comics now.

A bit odd that the Hood is there for Spider-Man, since I wouldn't consider him a Spider-Man related character, but neither is Taskmaster really.

I know she's just there because it's basically a list of all X-Men characters, but what I wouldn't give for a game with Pixie in a major role.

No Kamala or Sam, sadly. The former could've worked for both (being part mutant in the comics & now on the X-Men as well as being Miles' superhero bestie), while Sam would work for the latter in relation to Miles.

I'm the clown ctrl f'ing for academy X kids and getting excited seeing their names while knowing no game will ever seriously feature academy X kids.

Elixir and Prodigy aren't even there dam lol.

This is genuinely interesting to me, because getting rights to "the X-men" has always confused me, both in terms of videogames and movies.

I can wrap my head around a named character (i.e. the rights to Spider-Man) but with groups I tend to overthink (i.e. "does that mean certain characters insofar as they are dealing directly with X-men business? are certain characters fair game elsewhere as long as they are in a pre- or post- X-men era? Wolverine is a mutant, sure, but is he an X-man, broadly speaking?" etc.).

Seems like it was all a lot simpler than that.

IGs can request characters not on the list and they can be amended as has obviously been the case with the character I named in the OP and the one you mentioned. EDIT: NVM Cindy is there, but the point still stands.

For example IGs can request Black Panther. It'll be denied since that is tied to another publisher at this time. Let's say they want to use Deadpool/make a Deadpool game. They can request it and - assuming it's not tied somewhere else - it can be added.
