The law does not list out the things required for 'sanitary and safe' item by item so they are trying to claim that they are not breaking the law as the definition of sanitary and safe may be up to interpretation.

That's not how the government works. Also this happened on Friday so there wouldn't be time for anything but statements.
We already have laws against this. They should be suing/impeaching him and everyone else involved for violating those laws, except the people with standing to sue are locked in cages.
